In the article the author examines the organizational and legal aspects of functioning of probation personnel in Ukraine. Special attention is paid to legal regulation of the status of probation service employees, analysis of their rights, duties and professional competences. Normative legal acts regulating the activities of probation personnel including national legislation, are studied. The organizational and legal status of probation personnel is revealed, which includes a system of norms and regulations that determine their rights, duties, responsibilities, as well as the organizational structure and principles of functioning of the probation service. Probation workers have a number of rights that ensure performing their functions. The main duties of probation officers include monitoring the fulfillment of probation conditions, conducting individual work with persons under probation, preparing reports for judicial authorities and providing recommendations for further resocialization measures. The legal status of probation workers as participants in legal relations can be classified into general (constitutional), special (generic), sectoral and individual statuses. The main problems faced by probation staff in the context of organizational and legal challenges, such as insufficient funding, limited resources, high workload and lack of sufficient motivation, are and lysed. Specific recommendations are offered to improve the legal status of probation workers, their professional development and improvement of working conditions. The proposed measures are aimed at improving the efficiency of the National Probation Service ensuring the legal protection of its personnel and increasing the level of professional training. It was established that in order to overcome legal and organizational challenges, it is necessary to carry out complex measures aimed at improving legislative regulation, developing and implementing work standards of authorized bodies on probation issues, as well as ensuring adequate training and support of probation personnel. Probation personnel play a critically important role in ensuring public safety and social reintegration of offenders.
