Challenges of Legal Enforcement of the New Basis for Relief of Criminal Liability (Art. 781 of the Criminal Code of the Russian Federation)

The article provides a conceptual and legal-technical analysis of the grounds for exemption from criminal liability provided for in Article 781 of the Criminal Code of the Russian Federation. The shortcomings of the legal technique and the substantive aspect of the legislative novel are emphasized. The purpose of the work is to search for an algorithm for applying a new basis for exemption from criminal liability, since there are questions from the point of view of the flawlessness of the introduced legislative novel, namely: compliance with the general logic of the institution of exemption from criminal liability; legal and technical design and content aspect.
