رفع التعارض بين الأدلة بالجمع بتغاير الحال -دراسة في التراث المالكي- Removing the conflict between the evidence by combining the case differently - A study in the Maliki heritage-

يهدف هذا البحث إلى بيان جهود المالكية في رفع التعارض بين الأدلة، وذلك بدراسة مسلك من مسالك الجمع بين الأدلة المتعارضة وهو الجمع بتغاير الحال، من خلال مصنفات المالكية الأصولية والفقهية.تطرق البحث إلى مفهوم التعارض بين الأدلة، وحقيقته، ومسالك رفعه عند المالكية، مسلطاً الضوء على الجمع بتغاير الحال كأحد مسالك الجمع التي تناولها المالكية في تراثهم الأصولي والفقهي.وقد اعتمد البحث على المنهج الاستقرائي من خلال تتبع آراء المالكية الأصولية في التعارض بين الأدلة ومسالك الجمع بينها، والمنهج التحليلي وذلك من خلال تحليل وتفسير وجه التعارض بين الأدلة من جهة، وآراء المالكية الفقهية المترتبة على إعمال مسلك الجمع بتغاير الحال من جهة أخرى.وتوصلت الدراسة إلى جملة من النتائج، أهمها: أن المالكية لم يقصدوا في عامة مصنفاتهم الأصولية وضع حد جامع مانع لمفهوم التعارض بين الأدلة ومسالك الجمع بينها، وإنما كان استعمالهم للتعارض وفق مفهومه في اللغة، ويعتبر الطاهر ابن عاشور هو أبرز من حرر هذه المفاهيم، حيث بيّن مفهوم التعارض ثم فرّع عليه الترجيح والجمع والتعادل. كما أن الجمع بتغاير الحال هو أحد مسالك الجمع بين النصوص المتعارضة التي تناولها المالكية في مصنفاتهم الأصولية، فقد مثّل له بعضهم ونصّ عليه آخرون، وكان لهذا المسلك أثر في اختياراتهم الفقهية. This research aims to show the efforts of the Malikis in removing the conflict between the evidence, by studying one of the ways of combining conflicting evidence, which is the collection of different cases, through the works of the Maliki fundamentalist and jurisprudential. The research touched on the concept of contradiction between evidence, its truth, and the ways of raising it according to the Malikis, highlighting the plural with the variation of the case as one of the ways of collection that the Malikis dealt with in their fundamentalist and jurisprudential heritage.The research relied on the inductive approach by tracing the views of the fundamentalist Malikis in the conflict between the evidence and the ways of combining them, and the analytical approach through the analysis and interpretation of the contradiction between the evidence on the one hand, and the Maliki jurisprudential views resulting from the implementation of the collection path with the variation of the situation on the other hand. The study reached a number of results, the most important of which are: that the Malikis did not intend in general their fundamentalist works to put an end to the whole obstacle to the concept of conflict between the evidence and the ways of combining them, but was their use of conflict according to his concept in the language, and is considered Taher Ibn Ashour is the most prominent of the editor of these concepts, where between the concept of conflict and then a branch of weighting, addition and equivalence. The combination of different cases is one of the ways of combining the conflicting texts dealt with by the Malikis in their fundamentalist works, as some of them represented it and others stipulated it, and this path had an impact on their jurisprudential choices.
