Challenging Aspects of the Identification of a Conflict of Interests in Proceedings for Protection of Rights and Legal Interests of a Group of Persons

The article examines the problematic aspects of identifying and preventing conflicts of interest in proceedings for protection of the rights and legitimate interests of a group of persons. Considering the peculiarity of a class action, which consists in uniting of many various interests, the conclusion is argued, that determining the circumstances indicating the presence of a conflict of interest is a task of law enforcement in group proceedings, which must be resolved by judges individually every time, depending on the specific circumstances of the case.
