أثر الحيازة على الملكية دراسة فقهية مقارنة بنظام المعاملات المدنية السعودي The Effect Of Tenure On Ownership A Jurisprudential Study Compared To The Saudi Civil Transactions System

ظهر من خلال تتبع أحكام الحيازة في الفقه الإسلامي وفي القوانين المدنية المتأثرة به وجود بعض الأحكام المهمة في الحيازة لم يتطرق لها نظام المعاملات المدنية السعودي؛ كشروط الحيازة، والتفريق بين المنقول والثابت في الحيازة ونحوها، وعدم ذكر مدة التقادم في هذا الموضع؛ أسوة بغيرها من النظريات التي تعرض لها المنظم، وأوجد نص التقادم ضمن أحكامها. كما تقوم الحيازة على عنصرين مهمين أحدهما: الحيازة المادية، والتي تقوم على وضع اليد وتمام السيطرة. والآخر: معنوي، ويقوم على الحيازة بنية التملك. أكثر من تكلم في الحيازة من الفقهاء، وأفرد لها مساحة واسعة في التصنيف، وأشبع مسائلها بحثًا ودراسة هم فقهاء المالكية، ولا يساميهم في هذه المرتبة أي مذهب فقهي آخر، ثم يليهم الحنفية، ثم الشافعية والحنابلة على السواء وفي مواضع قليلة جدًا. جاء نظام المعاملات المدنية متفقًا مع المذاهب الفقهية الأربعة في تحديد قيمة الحيازة عند النزاع، وأنها تعد قرينة على ملكية الحائز للشيء المحوز. يترتب في حق الحائز حسن النية آثار منها: ملكيته للثمار التي قبضها مدة حيازته بنية تملكها، بخلاف سيء النية فلا يكون كذلك، وعدم مسؤولية الحائز عما يُصيب الشيء المحوز بسبب انتفاعه منه، بخلاف سيء النية فيكون مسؤولا، وترد إليه النفقات الضرورية دون الكمالية، ويتفق معه في هذا سيء النية أيضًا. وأما النافعة كالغراس والبناء، فترد له ما لم يضر قلعها بالأرض؛ فيأخذها المالك بقيمتها، وأما سيء النية فالمالك مخير بين إلزامه بالقلع، أو دفع قيمتها له مقلوعة. ويكون التقادم المانع من سماع الدعوى في نظام المعاملات المدنية هو عشر سنوات، ويتفق في هذا مع المذهب المالكي. يوصي البحث بالتوصيات الآتية: تضمين مدة التقادم في أحكام الحيازة وعدم الاكتفاء بالنص العام الوارد في المادة (295) من نظام المعاملات المدنية؛ أسوة بسائر النظريات الأخرى التي أوردها المنظم من جملة أحكامها. وتعديل عجز المادة (652) من نظام المعاملات المدنية ليكون وفق مذهب المالكية؛ لما يحققه من عدالة لكل الطرفين. By following up on tenure provisions in Islamic jurisprudence and in the civil laws affected by it, the researcher found that there were some important provisions in possession that had not been addressed in the Saudi civil transactions regime, such as the conditions of possession, the distinction between the transferee and the constant possession thereof, and the absence of any mention of the limitation period in this place; as with other theories to which the regulator was exposed, the statute of limitations was found in its provisions. Possession is also based on two important elements: physical possession, which is based on control and control. The other: moral, based on possession with the intention of ownership.More than two scholars have spoken of possession, and I devote a lot of room to it, and I fill its issues with research and study, which are royal physicists, and they are not named in this position by any other philanthropist, followed by faucet, and then both intercession and cabbage and in very few places. The civil transactions system is consistent with the four doctrines in determining the value of possession at the time of the dispute, and is a presumption of possession of the acquired object. The holder ' s right to good faith has consequences, inter alia: his ownership of the fruits that he received for the duration of his possession with the intention that he owned, other than bad faith, is not, and the holder ' s liability for the benefit of the object acquired, other than bad faith, is liable, and the necessary expenses are refunded without luxury, to which he also agrees in bad faith. The beneficial, such as the graze and the building, shall be returned unless its castle is damaged; the owner shall take it at its value, and the owner shall choose between his obligation to the castle or the payment of its value to him in question. The statute of limitations prohibiting the hearing of proceedings in the civil transactions system is 10 years, which is consistent with the royal doctrine.The study recommends the following recommendations: the limitation period should be included in the tenure provisions and not be limited to the general provision contained in article 295 of the Civil Transactions Regulations; as is the case with other theories cited by the regulator, among others. Article 652 of the Civil Transactions Regulations was amended to conform to the principle of property ownership, in order to ensure that it was fair to all parties.
