The author analyzes the legal definition of the concept of ‘safe work environment’ (contained in the Russian Labor Code). According to the author, the definition does not contain the necessary elements of this concept and, when interpreted literally, allows us to refer to safe working conditions cases when the employer does not provide the minimum safe values of normalized indicators (temperature, illumination, etc.). The identified defect leads to contradictions in the content of by-laws. The author offers an alternative definition of the concept of ‘safe work environment’ and justifies the need to clarify the legal definition.
