The paper discusses the ever-current relationship between international public law and the domestic legal order, with appropriate solutions from the domestic criminal legislation being pointed out. Basic conceptions of the relationship between international and domestic law, relevant provisions of the Serbian Constitution are presented, and the practice of the Constitutional Court of the Republic of Serbia in this area is presented. We concluded that the existing solutions of Serbian law correspond to those of comparative law and that they follow contemporary trends in the development of international (criminal) law, with certain improvements possible and desirable, from the aspect of improving the most important values such as the principle of respect for human rights and from the point of view of the further development of international law.
