The rules of international jurisdiction, as a subject of private international law in each country, determine which cases with a foreign element fall within the general jurisdiction of its courts and which fall outside this jurisdiction. Therefore, the national legislator in each country enjoys considerable freedom when establishing these controls. However, this does not mean that the rules of international jurisdiction are arbitrary. Rather, there are general foundations and principles that are taken into consideration when establishing these rules, the most important of which is the necessity of some form of judicial cooperation between the courts of different countries so that these courts can perform their work to the fullest extent. The importance of researching judicial commission emerges in particular when the courts of a country have jurisdiction over a particular case but are unable to undertake all the necessary procedures to resolve the case—as if the evidence in the case were located in another country.
