Real estate ownership is one of the most important pillars of economic and social stability for individuals and countries. However, this property is exposed to serious threats, especially in cases of confiscation for political reasons. This necessitates a strong legal framework to protect it.This research aims to examine how to protect real estate ownership from the risks of political confiscation under the Iraqi Property Claims Commission Law No. 13 of 2010, analyzing the legal provisions and their effectiveness in achieving the required protection. We adopted the analytical approach, where the researcher studied and analyzed the legal texts, their content and substance, in order to derive legal provisions into general provisions applicable to the facts presented in the confiscation and seizure of real estate for reasons such as punishment and without any fair compensation commensurate with the value of the property.The research topic will be divided into a research plan consisting of an introduction, a section, and two requirements. The first requirement is the concept of real estate confiscation, and the second requirement is the legal effects resulting from the confiscation of real estate.
