الحمد لله، والصلاة والسلام على رسول الله، وعلى آله وصحبه أجمعين، وبعد، هدفت هذه الدراسة إلى بيان المقصود بالحضانة، ومشروعيتها، والأحق بها، ولمحة عن نظام الأحوال الشخصية بالمملكة العربية السعودية، وإبراز أثر القدرة في استحقاق الحضانة، وكذلك الوقوف على التطبيقات القضائية على ذلك، وانقسمت هذه الدراسة إلى مقدمة، وثلاثة فصول، وخاتمة وفهرس: أما المقدمة عرَّفت فيها بأهمية البحث، وأسباب اختياره، وأهدافه، والدراسات السابقة ومنهج البحث وإجراءاته، وخطته، وتناولت في التمهيد: التعريف بالحضانة، ومشروعيتها، والأحق بها، ولمحة عن نظام الأحوال الشخصية بالمملكة العربية السعودية، ثم قدَّم المبحث الأول: أثر القدرة في استحقاق الحضانة، وتحدَّث المبحث الثاني: عن التطبيقات القضائية في أثر القدرة على استحقاق الحضانة، ثم عقَّبتُ ذلك بخاتمة اشتملت على أهمِّ النَّتائج، ومن أبرزها: أن الأم هي الأولى بالحضانة إذا توافرت فيها الشروط، وذلك بالاتفاق بين الفقهاء، وكذلك ما يقضي به النظام السعودي، وأنّ نظام الأحوال الشخصية السعودي لم يفترق كثيرًا عما قرره الفقهاء، وذلك فيما يخص المواد المنظمة لمسائل الحضانة ومسقطاتها، ومن أهمِّ التَّوصيات: توعية أفراد المجتمع بأهمية الحضانة وشروطها وأحكامها. والعمل على دعم وتمكين المرأة للحصول على حقوقها في الحضانة. Praise be to Allah. May His mercy and blessings be on the Messenger of Allah, on his family, and on his friends. This study aims to clarify the concept of custody and issues related to it. The study is divided into an introduction, a preface, two sections, and a conclusion. The introduction covers the importance of the research, the reasons for choosing its topic, its objectives, previous studies, the research methodology and procedures, and the study plan. The preface addresses the definition of custody, its legitimacy according to Sharia, those entitled to it, and an overview of the Law of Domestic Relations. The first section presents the effect of capability on custody entitlement. The second section discusses judicial applications of the effect of capability on custody entitlement. This is followed by a conclusion that includes the key findings, the most prominent of which is that the mother has the primary right to custody if she meets the conditions, as agreed upon by jurists, and in accordance with Saudi law. The Saudi Law of Domestic Relations does not differ significantly from what the jurists have established, particularly regarding the articles regulating issues of custody and its conditions. Among the most important recommendations are: raising awareness among community members about the significance of custody, its conditions, and its rulings, and working to support and empower women to obtain their custody rights.
