The article examines the problem of morality in the criminal process of modern Russia. The need is justified not only for a full-fledged regulatory consolidation of ethical principles here, but also for their correct understanding, awareness and compliance by the law enforcement officer in criminal proceedings. Only then is fair justice possible, which in turn strengthens the moral foundations of modern society and the state. The moral nature of the presumption of innocence, the key principle of proof, is examined the presumption of innocence is interpreted with an emphasis on its moral nature. On this basis an approach is proposed in which this constitutional principle acts as a guarantee of the embodiment of moral principles in domestic criminal proceedings and, accordingly, as a guarantee of fair justice.
