As part of the expansion of labor migration flows, the likelihood of legal conflicts in labor relations increases, which become more complicated under the influence of a foreign element. At the same time, legal errors most often and probably arise when concluding an employment contract with migrants in domestic practice, which is due to the complexity of compliance with the necessary legislative requirements by the parties to such relations, due to the imperative fulfillment of additional conditions that are provided for in the provisions of the labor legislation of Russia. In order to prevent legal conflicts that arise when concluding an employment contract with migrants, the author provides directions for overcoming them by using special conflict-of-laws rules — “bindings”.
