Bodies Authorized To Be Released From Criminal Liability On The Basis Of Effective Repentance

The article refers to the actual problems of exemption from criminal liability on the basis of effective repentance. It is aimed at analyzing the problems that have arisen during the application of this tool-the circle of bodies (persons) who have the authority to be released from criminal liability on the basis of effective repentance, its application by the court and other interrelated issues. In the course of the application of the new criminal and Criminal Procedure legislation of the Republic of Armenia, different approaches have appeared regarding the range of bodies (persons) authorized to use this tool, its application by the court and other interrelated issues. Within the framework of this article, the actual problems of exemption from criminal liability on the basis of effective repentance were analyzed and reasonable proposals for ensuring uniform practice were presented.
