The article deals with an analysis of the process of inclusion in the norms of the Criminal Code that establish liability for crimes in the sphere of public. Modern legislation contains a number of criminal law prohibitions aimed to protect social relations and to ensure public procurement. These norms are characterized by lack of consistency and competition. The unification of criminal law prohibitions, as well as the dissemination of legislative innovations, in particular the special grounds for exemption from criminal liability, should improve both law enforcement practice and minimize the criminal consequences of illegal acts in the field of public procurement.
