Criminal manifestations of separatism under the criminal code of the Republic of Moldova

In the present study are being investigated the crimes grouped under the nomen juris of separatism, provided by the art. 3401 of the Criminal Code of the Republic of Moldova. In order for this article to have its intended effect, the beneficiaries and recipients of the criminal law must be clearly explained the conditions under which art. 3401 of the Criminal Code of the Republic of Moldova can be applied. It is emphasized that this article can be applied only if the activity of separating a part of the Republic of Moldova – which the perpetrator carries out, instigates, finances, etc. – either involves the suppression of democracy and human rights, or is accompanied by the application of violence.
