إِنهاء عَقد العَمل وفقاً لأَحكام النِظام السعودي Termination of the employment contract in accordance with the provisions of the Saudi law

يعد نظام العمل في المملكة العربية السعودية أحد الأنظمة الهامة والحيوية التي تحدد المسؤوليات والضوابط والشروط المتعلقة بتنظيم علاقات العمل بين أصحاب العمل والعمال في المملكة، ومن ثم، فإن التعرف على ضوابط إنهاء عقد العمل وحالات إنهائه تعد محوراً هاماً في الحفاظ على حقوق جميع الأطراف وضمان سلامة العلاقة بين العامل وصاحب العمل، وعدم الخروج عن المألوف لمآرب أخرى سواء كانت من رب العمل أو من العامل نفسه، وفي هذا البحث سوف نسلط الضوء على الشروط التي تضمنها نظام العمل داخل المملكة العربية السعودية، وذلك بشأن إنهاء عقد العمل داخل المملكة، وحماية طرفي العقد من التعسف في استعمال سلطاتهم من أجل إنهاء العقد بدون مبرر مشروع وبعض الحالات التي تعد تعسفاً في إنهاء الخدمة، وذلك باعتبار أن عقود العمل هي أساس العلاقة بين أي عامل وجهة العمل التي يعمل بها، حيث يؤدي العامل مهنته طبقًاً لما ورد نصًا في وثيقة عقده دون زيادة أو نقصان، لذلك يجب علينا معرفة بنود عقد العمل، ومدى تماشيها مع مبادئ الشريعة الإسلامية والقواعد والأحكام العامة التي أقرها نظام العمل السعودي، وطرق إثبات ما يفيد التعاقد في حالة عدم وجود عقد، وأنواع عقود العمل، وشروط إنهاء العقد، وحالات إنهاء العقد، والتعويض المادي والمعنوي من جراء إنهاء العقد بغير مبرر مشروع، والحق في العودة للعمل، ومقدار التعويض، وحقوق العامل في أخذه شهادات الخبرة بناء على طلبه، ومكافاة نهاية الخدمة، ودور سلطة القاضي للتطرق لمثل هذه الأمور، كل هذه الإشكاليات تناولتها الدراسة بإيجاز غير مخل، للوقوف على معالجتها. The labor system in the Kingdom of Saudi Arabia is one of the important and vital systems that determine the responsibilities, controls and conditions related to the organization of labor relations between employers and workers in the Kingdom, and therefore, identifying the controls for terminating the employment contract and cases of its termination is an important axis in preserving the rights of all parties and ensuring the integrity of the relationship between the worker and the employer, and not to deviate from the ordinary for other purposes, whether from the employer or from the worker himself, and in this research we will highlight The conditions included in the Labor Law within the Kingdom of Saudi Arabia, regarding the termination of the employment contract within the Kingdom, and the protection of the parties to the contract from abuse of their powers in order to terminate the contract without legitimate justification and some cases that are arbitrary in termination of service, considering that employment contracts are the basis of the relationship between any worker and his work establishment, where the worker performs his profession in accordance with the stated A text in his contract document without increase or decrease, so we must know the terms of the employment contract, and the extent to which they are in line with the principles of Islamic Sharia and the general rules and provisions approved by the Saudi Labor Law, and ways to prove what benefits the contract in the absence of a contract, types of employment contracts, conditions for termination of the contract, cases of termination of the contract, material and moral compensation as a result of termination of the contract without legitimate justification, the right to return to work, the amount of compensation, the rights of the worker to take experience certificates upon his request, and the end of service gratuity, And the role of the judge's authority to address such matters, all these problems were dealt with in the study briefly and without prejudice, to find out how to address them.
