As part of the study, a gap was identified in the legal regulation of relations regarding the use of subsoil, in terms of the lack of clear legislative recognition of the concept of subsoil use waste. Considering this circumstance, in practice, problems arise related to the impossibility of distinguishing subsoil use waste from related legal structures, such as production and consumption waste, secondary resources, which entails unjustified competition of regulatory legal acts. Based on the analysis of legal regulations, judicial practice and doctrinal sources, system-forming legal features were identified, formulated, justified, and the author’s definition of subsoil waste was given. As a result of the study, specific proposals and recommendations were formulated for introducing amendments to the norms of the current legislation.
