The Right to the Statutory Share in an Estate and Problems of Its Exercising in Contemporary Russia

The article examines the problems of legislative consolidation and practical implementation of the right of minors and disabled persons to a mandatory share in inheritance by will and inheritance agreement based on the constitutional provision on the Russian Federation as a social state. Attention is drawn to the relationship between the right to a compulsory share and the validity of an inheritance contract as an independent basis for inheritance. The necessity of improving inheritance legislation is substantiated, fi rst of all, its focus on protecting the rights of socially vulnerable persons in modern Russia.
