The Position of the Surviving Spouse in Inheritance of Rights Associated With Being a Member of a Commercial Corporation

The article examines the theoretical and practical problems of the position of the surviving spouse in the succession of rights related to participation in a commercial corporation. The author analyses the content of the status of the surviving spouse, the peculiarities of the exercise of his rights in the event of the death of the participant (member) of a commercial corporation. The article analyzes the jurisprudence on the succession of corporate rights by the surviving spouse. The author concludes that it is necessary to use the tools of hereditary planning and emphasizes the high importance of family entrepreneurship in modern Russian law.
