Purpose. To carry out a critical review of existing approaches to understanding the legal system and to identify possible ways to build a new methodology for its perception. Methodology: were used by the author as general scientific (method of dialectical materialism, analysis, synthesis, etc.) and special legal methods. Conclusions. The study demonstrates the consequences to which the dialectical tradition of legal positivism leads to the dichotomy of the legal system and the legislative system. One of the most important consequences of using sociological positivism for understanding the legal system is a departure from the problem of the relationship between the external and internal forms of law. Scientific and practical significance. Consideration of the structuring of law, as taken beyond the dialectical understanding of legal reality, provides great opportunities for understanding the connections of various normative elements with each other, and the consequences described above play an important methodological role.
