The process of legislating laws is of great importance within the framework of the legal reality because of its impact on achieving public benefit and protecting public order and because of what this issue represents in its connection to the core of the country’s life as it casts a shadow on the requirements of every period. Generally, in 2005, the constitutional legislator in Iraq entrusted the executive authority to submit proposals for draft laws to the legislative authority, given that the parliamentary system is based on cooperation and oversight between the two authorities. However, this process goes through stages of scrutiny and purification that are the responsibility of the government (the executive authority), supported in this by the administrative judiciary represented by the State Council, so that the legislation appears in a way that is consistent with and complements the rest of the legislation in force. The reason the executive authority undertakes this process is because it is closest to the needs of individuals and most capable of meeting them.
