The article analyzes the issues of the application of the civil law institute of damages to the relations of social security law. Based on the study of law enforcement practice and the works of legal scholars, the author identified two of the most fundamental problematic issues - determining the legal nature of losses in social security relations and the possibility of their retrospective recovery. It is noted that the nature of the institution of damages leans towards private law, but in public law it is necessary to provide a similar mechanism, where possible.
