The Legal Regulation of Case Distribution in Courts: Implementation on the Example of the New Regions of the Russian Federation

The subject of this article is the theoretical and legal aspects of the analysis and accounting of the organization of an electronically automated system for the distribution of court cases in the new fullfledged subjects of the Russian Federation: the DPR, the LPR, the Zaporozhye and Kherson regions in the context of the expansion of its territorial borders in accordance with the decree of the President of the Russian Federation dated October 5, 2022 regarding the transformation of the basic foundations of judicial proceedings in new regions Integration of the Russian Federation into the Russian legal space, taking into account its digital vector development, which ensures the efficiency of the work of courts of all levels and instances. The author reveals the features of the modification of the judicial system of the new regions of the Russian Federation in the context of the introduction of an automated electronic system for the distribution of cases between judges and the reform of its fundamental procedural and legal institutions. Exploring the most pressing problems of legislative detailing of an electronically automated system for the distribution of court cases from the initial receipt of the case, to possibly its subsequent redistribution between individual judges, the author proposes additions and changes to the current legislation in the relevant part, allowing to build a clear and demanded system of automated distribution of court cases by a law enforcement officer, taking into account, among other things, the peculiarities of both the legal foundations of the new territorial units and the work of their state and government structures. He particularly draws attention to the problems of the workload of judges in the mechanism under study, taking into account the legal complexity of various categories of cases; cases of impossibility of using (using) such an automated electronic system and the necessary equipment — providing (filling) courts with information resources — for the distribution of judicial cases; constituting in their entirety the novelty of scientific research. The importance of adopting certain conceptual normative legal documents is emphasized — the Federal Law “On Judicial Workload”, the Federal Law “On Automated Procedure and the application of rules of a different order of distribution of cases in courts”, using methods of: system analysis, interpretation of legal norms, logic, formal legal.
