Administrative Law and Traffic Accidents: Legislative Shortcomings and Their Economic and Health Implications (A Comparative Study)

This study explores the role of administrative law in regulating road safety, highlighting legislative and administrative shortcomings in Iraq and their economic and public health implications. Through a comparative analysis with other legal systems, the research reveals that weak coordination among relevant authorities, the absence of binding technical standards, and poor enforcement contribute significantly to traffic accidents. The study recommends strengthening the role of administrative institutions, updating legislation in line with international standards, and enhancing legal and regulatory oversight to reduce accidents and mitigate their societal impact. Despite multiple legislative efforts in Iraq to reduce traffic accidents, the rate of accidents and casualties remains high, indicating legislative and administrative shortcomings in the traffic legal system. This is clearly reflected in the economic and health situation. This raises a central question: To what extent have legislative shortcomings in administrative law contributed to the exacerbation of traffic accidents in Iraq, and what are their economic and health impacts compared to regional and international experiences?
