The National Archives Act 2003 (Act 629) is an act enacted to ensure that public records and public archives in Malaysia can be properly preserved for present and future reference. Among the provisions in this act are related to offenses against the public and public archives as well as punishments for record offenders who commit such offences. In relation to that, the objective of this paper is to analyze the question of what the types of offenses and punishments are. In addition, the types of offenses and punishments found in this act will be compared with the types of offenses and punishments found in laws related to public records and public archives that are being enforced in foreign countries. The method used to analyze this question is to use the literature review method against the content of information sources such as books, articles, acts, regulations and other related documents. Based on this analysis, the findings are that there are five types of offenses against public records and public archives and one type of punishment provided under this act. In addition, there are some differences and similarities related to the types of offenses and punishments under this act when compared to the types of offenses and punishments related to public records and archives that are being enforced in foreign countries. These findings will be discussed in more depth in this paper. It is hoped that the discussion from this paper will contribute to increasing the reader's knowledge about the types of offenses and punishments related to public records and public archives that are being enforced under the National Archives Act 2003 (Act 629) in Malaysia as well as its comparison with foreign countries. It is also hoped that the findings from this preliminary analysis will be a catalyst for more in-depth research related to this question in the future.
