The Legal Regulation Hurdles of the Blockchain-Based Contracts for Maritime Transport

This paper investigates the various challenges inherent in regulating documents affected by technological innovation, with a particular focus on blockchain technology. Furthermore, it sheds light on the regula- tory complexities surrounding blockchain-based maritime documentation for maritime transport. The study also delves into the potential implications of this technological advancement on maritime docu- mentation. Longitudinally, the paper mines information and reveals inherent laws, controversialities, compati- bilities, sensitivities, and (positive and negative) legal implications of the harmonisation of blockchain technology in light of the adopted international legal instruments. The paper scrutinises understand- ing and perhaps fills the gap regarding the influence of blockchain technology on maritime shipping contracts. Horizontally, the paper carries out an analytical reflection and constructive assessment of the compatibility of blockchain-based documentation with the regulatory landscape developed by international and regional organisations and stakeholders. Correspondingly, the paper finds that the interdependence between technological innovations and mari- time documents, as variables, shall be progressive and positive. The paper drew out constructive suggestions to establish a technologically friendly regulatory environment, uniform standards, and practices for the application of blockchain technology.
