يتناول هذا البحث جملة من الأحكام المتعلقة بعقد الأجير الخاص، فيبين حقيقته وأقسامه، ويركز البحث في الآثار الناشئة عن العقد، المتعلقة بالفسخ، والتعويض، والضمان، وتأتي أهمية البحث من موضوعه، وهو عقود الأجراء، والعمال، وأوضاع العاملين في قطاعات التوظيف، وتظهر الأهمية في أن عقد الأجير الخاص من أهم العقود، وأكثرها إجراء وتطبيقًا، وتتعلق به حقوق العاملين وأصحاب العمل، وأن الإجارة بنوعيها، سواء كانت إجارة أعيان، أو إجارة أشخاص، من أهم الصيغ الاستثمارية والتمويلية، حيث تصاغ منها صكوك الإجارة، وتمول منها الخدمات التي تسد حاجات الناس، ويقضون بها مصالحهم، وأن المسائل المشكلة، المتعلقة بإنهاء عقد العمل وفسخه، وتعويض صاحبه، ليست قليلة، وعليها مدار الدعاوى العمالية، والقضاء العمالي، وكثير من هذه المشكلات محسوم من الناحية الفقهية، قبل ظهور أنظمة العمل. وقد توصل البحث إلى أن عقد الأجير الخاص هو عقد العمل، وهو العقد الوارد على منفعة معينة، من شخص معين، طبيعيًا كان أو اعتباريًا، مقابل أجر معلوم، في مدة محددة، وقد يكون عقدًا واردًا على منفعة موصوفة في الذمة، وأنه لا خلاف بين المذاهب الفقهية أن صاحب العمل إذا فسخ عقد الأجير الخاص قبل انتهاء مدته لغير سبب من الأسباب المعتبرة، أنه يغرم بقية مدته، وهذا من مقتضيات العقد، ومن الآثار الناشئة عن لزوم العقد، وأنه لا خلاف بين المذاهب الفقهية أن الأجير الخاص أمين، لا يغرم ما تلف تحت يده، ولا ما تلف بفعله، إلا في حالين: حال التعدي، وحال التفريط، وقد أخذ نظام العمل السعودي بهذا الحكم المستقر في المذاهب الفقهية. The research specifically emphasizes the effects arising from the contract, such as termination, compensation, and guarantee. The importance of this research lies in its subject matter, which is employment contracts and the conditions of workers in the recruitment sectors. The significance becomes evident as the private employment contract is one of the most important and commonly used contracts, involving the rights of workers and employers. Renting, whether of objects or people, is one of the most significant investment and financing forms. It is the basis for lease certificates and the funding of services that meet people's needs and serve their interests. Issues related to terminating an employment contract, dissolution, and compensating the employer are not uncommon. They are the subject of labor lawsuits and labor adjudication. Many of these issues were settled from a jurisprudential perspective before the emergence of labor laws. The research concludes that the private employment contract is an employment contract that provides a specific benefit from a specific individual, whether natural or legal, in exchange for a known wage within a specified period. It may be a contract based on specified liability. There is no disagreement among the jurisprudential schools that if the employer terminates the private employment contract before its expiration without a valid reason, they are liable for the remaining period. This is a consequence of the contract and its binding nature. There is also no disagreement among the jurisprudential schools that the private employee is responsible and liable for any damage caused under their supervision or as a result of their actions, except in two cases: aggression and negligence. The Saudi Labor Law has adopted this settled ruling among the jurisprudential schools.
