إذا تقرَّر أنَّ الشرع جاء من كلام الله تعالى، وكلام صاحب الرسالة e، وأنه -تعالى- حكيمٌ في أحكامه، خبيرٌ بما شرعه؛ فإنَّه لا يُمكن أن يحصُل تعارُض حقيقي في كل الوجوه بينَ دليلَين، بحيث لا يُمكن الجمعُ بينَهما بأي وجهٍ من الوجوه، فإن كان ثمَّة تعارُض ظهَر لبعض المجتهدين؛ فإنه تعارُضٌ ظاهرٌ نِسبيٌّ، لكنَّه عند التحقيق فهو تعارُضٌ ظاهرٌ نِسبيٌّ لبعضٍ دونَ آخَرين. والقارئُ للفقه يرى أن ثمَّة مسائل كثيرة ورَد فيها من الأدلَّة ما ظاهرُه التعارُض، وتبايَنَت مسالك أهل العلم في بيان عدم التعارُض فيها، إما ببيان الناسخ من المنسوخ، أو الجمع، أو الترجيح، أو القياس. وقد تصدَّى أهلُ العلم المتقدِّمون والمتأخِّرون بدَحْض تلك الشكوك والأوهام بالأدلَّة والبراهين، ووضَعوا قواعد وطرُقًا لبيان دفْع التعارُض بينَ الأدلَّة، وتنوَّعت مسالِكُهم في دفْع التعارُض.
