On the Constitutional Law Definition of Supervision Exercised by Prosecution Authorities of the Russian Federation and Its Reflection in Regulatory Acts

The article is devoted to the problem of defining the constitutional-legal concepts of “supervision over compliance with the Constitution of the Russian Federation and the execution of laws” and “supervision over the observance of human and civil rights and freedoms” contained in the provision of part 1 of article 129 of the Constitution of the Russian Federation. Due to the fact that these concepts are not limited to the scope of supervision of the activities of specific subjects of law, it is concluded that they are broader in scope and content of the concepts of “supervision of the execution of laws” and “supervision of the observance of human and civil rights and freedoms”, enshrined in the titles of chapters 1 and 2 of section III of the Federal Law No. 2202-1 of January 17, 1992 “On the Prosecutor’s Office of the Russian Federation”. The author believes that the supervisory function of the Prosecutor’s Office of the Russian Federation has not been defined by federal law in its full constitutional-legal scope and content to date. In this regard, the hypothesis is put forward and substantiated that, in the part undefined by federal law, certain areas of supervision can be determined by regulatory legal acts of the President of the Russian Federation and (or) the Prosecutor General of the Russian Federation.
