The generic juridical object of the exercise of duties in the public sector in a conflict-of-interests situation

This investigation contains the analysis of the generic juridical object of the offenses of exercising duties in the public sector in a conflict-of-interest situation, provided by the art. 3261 of the Criminal Code of the Republic of Moldova. For this purpose, the meaning of the syntagmas „public sphere”, “activity in the public sphere” and “good performance of activity in the public sphere” used to describe the generic juridical object of the offenses provided by the Chapter XV of the special part of the Criminal Code of the Republic of Moldova is determined. In conclusion, it is argued that the title „Offenses against the good performance of activity in the public sphere” expresses the juridical essence of the offenses provided by the Chapter XV of the special part of the Criminal Code of the Republic of Moldova.
