This article aims to provide a theoretical and critical analysis of the notion of “rights” in the Brazilian State, based on the assumption that poverty is one of the most challenging rights violations to be faced in the country. Following this logic, by continuing political mechanisms that perpetuate poverty, the State can also be considered a rights violator, using its public policies as tools to maintain social conditions that contribute to such violation, including the Social Assistance policy. To carry out this analysis, a bibliographic study was carried out, intentionally choosing references that would allow an approach to the topic. In addition, documentary research made, in search of laws and normative documents to support the discussion.
