The scientific article is devoted to the issues of non-fulfillment and improper performance of official duties, as a type of criminal inaction of employees of EMERCOM of Russia. The relevance and acuteness of this issue has been scientifically substantiated. Specific examples show the nature and degree of public danger of these crimes, statistical data are provided, which also substantiate the relevance of the subject of scientific research. Based on the analyzed materials of judicial practice, as well as the doctrinal positions of scientists, a conclusion is drawn about the existing problems of legal regulation and law enforcement practice in the field of criminal liability of employees of EMERCOM of Russia in connection with their commission of illegal acts related to non-performance or improper performance of official duties. Measures have been proposed (both legal and legislative, as well as practical), the implementation of which will allow these problems to be resolved.
