This article analyzes the implementation of residential eviction moratoriums during the COVID-19 pandemic and the role of the judiciary in enforcing them. This article examines how courts interpreted, applied, and sometimes struggled to reconcile emergency protections with existing landlord-tenant law. This article highlights inconsistencies in judicial approaches and the practical challenges faced by tenants, landlords, and courts. This article also considers policy and legal reforms to improve the effectiveness of future emergency housing protections.
