The e-sports industry has emerged as one of the fastest-growing segments of the digital entertainment economy, gaining significant popularity among youth and professional gamers in India. With the rapid expansion of internet connectivity, smartphone usage, and online gaming platforms, e-sports has evolved from casual gaming into a structured competitive activity. However, despite its growth potential, the industry faces several legal and regulatory challenges that hinder its development. The absence of a clear legal definition, confusion between e-sports and online gambling, and fragmented state-wise regulations create uncertainty for stakeholders. Issues related to player contracts, intellectual property rights, taxation, data privacy, and protection of minors further complicate the legal landscape. Additionally, the lack of a dedicated governing authority and dispute resolution mechanism affects transparency and fair play in tournaments. This article examines the legal status of e-sports in India and identifies the major challenges affecting its growth. It also highlights the need for a uniform regulatory framework and provides recommendations for strengthening e-sports laws. Establishing clear policies and regulatory oversight can promote investor confidence, protect players, and support the sustainable development of the e-sports industry in India.
