The subject of criminal protection of undisclosed information gains its importance from the importance given to this information itself, which is also known as trade secrets. It is noted that some legislation refers, through clear and explicit texts, to this information and to the conditions that must be met in order for it to be the subject of criminal protection. In order to provide sufficient guarantees to confront any behavior that constitutes an attack on it by others through illegal disclosure, disclosure, use or possession without the consent of its owner and in a manner that violates honest commercial practices. Due to the confidential nature of undisclosed information, it has become of commercial value. All of this has had a significant impact on the call to provide effective criminal protection for information, whether at the international level or at the local level. The problem of the research lies in the fact that the increase in the forms and types of attacks on undisclosed information in a large number of countries has led to a large number of inventors and innovators refraining from their inventions.
