With the continuous progress in the field of artificial intelligence, the breadth and depth of deep learning technology is being strengthened. Although the technology itself is neutral, it is necessary to pay attention to the boundaries of the use of data and to comply with legal regulations in the process of practical application. Regarding the “data mining” and other types of behaviour in deep learning, a comprehensive judgment should be made based on the reproduction right in the field of copyright law, and at the same time, the dissemination effect formed by the cumulative technical characteristics of the reproduction of deep learning technology should be analysed, so that whether or not to obtain the reproduction legally should be taken as the basis of the infringement judgment. Ultimately, the prohibited areas of copyright use and the boundaries of protection should be clarified to avoid the risk of violation of law and promote the sustainable development of the industry.
