اشتراط كمال الزوجين في العقل والبلوغ والحرية للإحصان في حد الزاني المحصن - دراسة فقهية Sanity, Puberty, and Freedom as Requirements for the Legal Punishment of Married Adulterers A Jurisprudential Study

اعتنى هذا البحث بذكر أحكام اشتراط كمال الزوجين في العقل والبلوغ والحرية للإحصان في حد الزاني المحصن، بدراسة فقهية استقرائية تحليلية، حيث بيَّن البحث حكم الزنا والحكمة من تحريمه وأراء الفقهاء في إمكانية ضم عقوبة التغريب إلى الجلد، والجلد مع الرجم، مع بيان عقوبة جريمة الزنا للمحصن، وغير المحصن، وبيان مدى اشتراط الكمال بين الزوجين كأحد شروط الإحصان ومدى اشتراط استمرار عقد الزوجية للإحصان، وظهر من خلال البحث أن الفقهاء يفرقون بين عقوبة الزاني المحصن والزاني غير المحصن بناء على ما ورد في هذه العقوبة من الأحاديث التي تكاد تكون شبه متواترة، وهم متفقون على أن عقوبة الزاني غير المحصن هي الجلد مائة جلدة، والتغريب مدة عام - على خلاف بينهم في التغريب، وأن عقوبة الزاني المحصن هي الرجم بالحجارة، كما أنهم اتفقوا على أكثر شروط الإحصان ومن أهمها: أن يكون المحصن متزوجا، وأن يكون عقد زواجه صحيحا، وأن يقترن العقد بالدخول، واختلفوا في اشتراط تحقق الكمال في العقل والبلوغ والحرية بين الزوجين لكي يكون الزاني محصنا، والقول الأظهر هو اشتراط ذلك في الزوجين جميعا فإن كان أحد الزوجين كاملا والآخر ناقصا فلا إحصان، وأن اشتراط قيام الزوجية كشرط من شروط الإحصان لم يتطرق إليها الفقهاء من قبل؛ لأنهم يرون أن من تزوج فقد أصبح محصنا بغض النظر عن استمرارية هذا الزواج لكي يبقى محصنا. This research focuses on detailing the rulings regarding the requirement of the spouses' completeness in terms of sanity, puberty, and freedom for the punishment of adultery through an inductive and analytical jurisprudential study. The study explains the ruling on adultery and the wisdom behind its prohibition. It also explores the opinions of jurists on the possibility of combining the punishment of exile with flogging and flogging with stoning. Additionally, it clarifies the punishment for the crime of adultery for both married and unmarried individuals. Jurists distinguish between the punishment for an adulterer who is married and one who is unmarried based on hadiths that are almost widely transmitted (mutawatir). They agree that the punishment for an unmarried adulterer is one hundred lashes and exile for one year, although they differ on the specifics of the exile, and the punishment for a married adulterer is stoning to death. Jurists are also agreed on most of the conditions required to regard a person as Muhṣan (married, hence liable to a more severe punishment in case of adultery), among the most important of which: the Muhṣan must be married, their marriage contract must be valid, and the contract must be accompanied by consummation. As for sanity, puberty, and freedom of both spouses, the predominant opinion is that they are necessary conditions for both spouses in order for the adulterer to be Muhṣan. Jurists see that whoever gets married has become Muhṣan regardless of the continuity of this marriage.
