The article analyzes the statistics of the courts of appeal and cassation instances of the Moscow Judicial District on the basis of judicial acts adopted following the consideration of such disputes related to the application of Articles 445 and 446 of the Civil Code of the Russian Federation, and also examines the general trends and features of the results of the analysis. In conclusion, the conclusion is made about the general importance of the institution of regulatory legal regulation of precontractual disputes, if the contract being negotiated is binding to conclude.
