In the article, the author conducts a comparative study of the refl ection of the principle of freedom of will in the rules on inheritance of Russia and the Federal Republic of Germany, analyzing the norms of Part three of the Civil Code of the Russian Federation and the German Civil Code on special types of testamentary orders and one of such special orders in Russia and Germany is a testamentary refusal.
