Controversial Issues of Subjective Signs of Corpus Delicti under Art. 156 of the Criminal Code of the Russian Federation

The article discusses controversial issues related to the mandatory feature of the subjective side of the corpus delicti provided for in Article 156 of the Criminal Code of the Russian Federation as guilt, as well as to the subject of this crime. The position is substantiated, according to which the failure to fulfill the duties of raising a minor, combined with ill-treatment of him, is committed only with direct intent. Based on the analysis of the disposition of Article 156 of the Criminal Code of the Russian Federation, normative legal acts of the Russian Federation and explanations of the Plenum of the Supreme Court of the Russian Federation, the circle of persons who may be subjects of the specified corpus delicti is determined.
