The article discusses some issues of understanding international competence as a competing one. The complexity of establishing the competence of the court of the Russian Federation in determining it using evaluative concepts is shown. Judicial acts on the determination of the competence of the court of the Russian Federation are characterized as having a preliminary character. The solution of controversial issues of the presence or absence of international competence within the framework of the preliminary court session is proposed.
