The presented legal analysis is in no way aimed at defending the use or denial of the death penalty as an exceptional measure of criminal punishment for particularly serious crimes against human life. The author is faced with the task of considering issues of exclusively legal regulation (normative consolidation) of the establishment of a moratorium on the use of the death penalty in the Russian Federation. Analyzing the legal status of the current moratorium on the death penalty in the Russian Federation, it is concluded that there are no legal grounds for its implementation. The termination of the international treaties of the Council of Europe in relation to the Russian Federation, in connection with the termination of the membership of the Russian Federation in this international organization, requires a revision of the position and reasoning of the Constitutional Court of the Russian Federation on the issue under study.
