Peculiarities of state policy in the field of national minorities (communities) of Ukraine

The article analyzes the theoretical-legal and normative principles of state policy regulation in the sphere of national minorities of Ukraine. Features and main approaches to understanding state policy and national minorities as legal categories are defined. The key principles of state policy in the field of national minorities are considered, and the specific goals and principles of this state policy, corresponding guarantees of the realization of the rights and freedoms of national minorities are consistently analyzed. It has been established that the goals and principles of such state policy, as well as separate legislative guarantees for the protection and realization of the rights and freedoms of members of national minorities (communities) as a whole form the basic principles of modern state policy in the field of national minorities (communities). The legislative uncertainty of measures and guarantees for the protection and realization of the rights and freedoms of persons belonging to national minorities (communities) was noted, which does not correspond to the principle of legal certainty, complicates law enforcement and cannot effectively ensure the achievement of the goals of state policy in the field of national minorities (communities). It was established that the goals of this state policy also need clarification and more detail, they should be provided with a clear organizational and legal mechanism for their implementation. It is substantiated that the state policy in the field of national minorities (communities) should provide for the broad effective participation of the state in preserving the authenticity of national minorities (communities), in particular, not exclusively by providing them with relevant state support and guarantees, while not allowing interference in the internal issues of the life of national minorities (communities). Guaranteeing the protection and realization of the rights and freedoms of persons belonging to national minorities (communities) today requires the development and actual implementation by the state with the participation of representatives of national minorities (communities) of a set of specific measures aimed at supporting and developing the identity and identity of national minorities (communities), their integration into Ukrainian society.
