The article deals with the problems of protecting the property rights of spouses in cases where joint property, registered only for one spouse, is alienated by them without the consent of the other. It is concluded that the protection of the rights of spouses is insufficient due to the shift in emphasis towards a conscientious acquirer of marital property. Based on the analysis of legislation and judicial practice, it is proved that the spouse must monitor the state of family assets and take measures to formalize his rights to property.
