Abstract With the introduction of the Trust, Estate, and Foundation (TEF) Rules, in force from 1 July 2025, Switzerland is further strengthening its position as a prime jurisdiction for the arbitration of trust, estate, and foundation disputes. The new Rules provide a modern, efficient, and confidential process tailored to the needs of high-net-worth (HNW) families as well as trust and foundation practitioners. The TEF Rules are expected to increase the use of arbitration in private-wealth matters. In addition to the model arbitration clauses, the TEF Rules contain provisions on their scope of application; information, notification, and representation of entitled persons; appointment of the arbitral tribunal; and applicable law in estate matters.
