Technogenic man of the future - freedom or subjective right (theoretical, legal and philosophical reflections)

The article examines the complex and multidimensional issue of legal regulation concerning the emerging phenomenon of the technologically modified human of the future. The author analyzes the potential impact of human technological modification on key areas of public life. Particular attention is given to the transformation of interpersonal relationships in the context of the potential to manipulate emotional states and memory, raising questions about the authenticity of human connections. The article also explores the potential impact of genetic modifications on natural evolutionary processes and the risk of homogenizing the human population. A significant focus is placed on the risks of deepening social stratification due to unequal access to advanced biotechnologies, which may result in the emergence of a new hierarchical social structure. The article addresses the tension between individual freedom in pursuing technological self-enhancement and their right to do so, especially in light of rapid developments in artificial intelligence, neurointerfaces, biotechnology, and concepts of human design. The article further explores the opportunities and risks of transforming human nature, including digital discrimination, shifts in identity, and ethical dilemmas surrounding digital immortality via technological transfer of consciousness. The political consequences of such modifications are also considered, including the electoral rights of modified individuals and the potential evolution of democratic institutions towards technocracy. Special emphasis is placed on cybersecurity issues associated with technological integration into the human brain. The author proposes potential directions for the evolution of legal doctrine to ensure a balance between individual freedoms and the protection of fundamental rights in a future techno-integrated society.
