The article examines the peculiarities of approaches to private property in foreign legal systems - in particular, in countries of the Romano-Germanic and Anglo-American legal families, using the example of the USA, France and Germany. At the same time, in foreign legal systems there is a tendency to harmonize legal norms regulating the institution of private property, taking into account national characteristics and international standards. This creates the prerequisites for comparative analysis and borrowing positive experience in order to improve national legislation. It is noted that in the context of globalization and digital transformation of society, the institution of private property is acquiring new forms and content, which requires a corresponding update of legal regulation. The importance of private property as a basic element of the rule of law, a guarantee of economic freedom of the individual and stability of the law and order is emphasized. It is concluded that in order to strengthen the institution of private property in Ukraine, it is advisable to unify the legislation on forms of ownership. It is also important to increase the level of legal awareness of citizens regarding their rights and mechanisms for their protection, taking into account international experience and adapting best practices to the national context.
