The Financial Costs of Administrative Litigation: A Comparative Study between Palestine and Tunisia

Objective: This study aims to evaluate the compatibility of the Palestinian Decree-Law No. 41 of 2020 concerning administrative courts with the principle of free access to justice. This is especially significant in light of Decree-Law No. 22 of 2022 regarding administrative court fees, which significantly raised the fees imposed on administrative claims and appeals in Palestine, thereby increasing the difficulty of accessing administrative justice. The study also compares the Palestinian and Tunisian legal systems in their approaches to the issue of legal costs and fees, in line with the principle of free litigation. An inductive, analytical, and comparative methodology was used by analyzing and studying the provisions of the decree-laws related to administrative courts and litigation fees in Palestine, with a comparison to the Tunisian system. Findings: The study concludes that the judicial fees imposed within the Palestinian administrative judiciary place a heavy burden on litigants, posing a serious challenge. This approach may discourage citizens from claiming their rights and undermines their trust in the judicial system. This stands in contrast to the Tunisian experience, where administrative justice is viewed as an effective refuge for protecting rights, rather than an additional financial burden. Recommendations: The study strongly recommends the need to reconsider legislative policies related to administrative court fees in Palestine by amending the conditions for filing administrative claims, revising the fee schedules, and establishing a legal aid system. This would help strike a balance between funding justice and ensuring everyone’s right to litigation without discrimination or exclusion, taking the Tunisian model as a reference. الهدف: تهدف الدراسة الى تقييم مدى مواءمة القرار بقانون رقم (41) لسنة 2020 بشأن المحاكم الإدارية مع مبدأ مجانية التقاضي، خاصة مع صدور القرار بقانون رقم (22) لسنة 2022 بشأن رسوم المحاكم الإدارية الذي جاء ليرفع بشكل ملحوظ الرسوم المفروضة على الدعاوى والطعون الإدارية في فلسطين، وهو ما يزيد من صعوبة الوصول الى العدالة الإدارية. كما تقوم الدراسة على المقارنة بين القانون الفلسطيني والقانون التونسي في كيفية تناول كل منهما لإشكال التكاليف والرسوم القضائية بما يتماشى ومبدأ مجانية التقاضي. تم خلال هذا البحث استخدام منهج استقرائي تحليلي مقارن من خلال تحليل ودراسة نصوص القرار بقانون المتعلق بالمحاكم الإدارية ورسوم التقاضي بفلسطين أين تمت المقارنة مع النظام التونسي. النّتائج: انتهت الدراسة إلى أن الرسوم القضائية المفروضة صلب أروقة القضاء الإداري الفلسطيني تثقل كاهل المتقاضي بمصاريف الدعوى امام القضاء الإداري وتمثل اشكالية حقيقية حيث تبرز خطورة هذا النهج في انه قد يؤدي الى عزوف المواطنين عن المطالبة بحقوقهم كما يقوض ثقتهم في النظام القضائي، على خلاف التجربة التونسية أين ينظر الى القضاء الإداري كملاذ فعّال لحماية الحقوق، لا كعبء مالي إضافي. التوصيات: توصي الدراسة على الحاجة الملحّة لإعادة النّظر في السياسات التشريعية المتعلقة برسوم المحاكم الإدارية بفلسطين من خلال تعديل شروط رفع الدعاوى الإدارية، مراجعة جداول الرسوم، وتأسيس نظام قانوني للمساعدة القضائية بما يحقق التوازن بين متطلبات تمويل العدالة وضمان حق التقاضي للجميع دون تمييز أو إقصاء، استنادا في ذلك للنظير التونسي.
