The article examines the legal nature of the comprehensibility of court decisions as a basis for criminal proceedings. The author emphasises that ensuring the clarity of court decisions is a key prerequisite for the implementation of the principles of the rule of law, justice and access to justice. In the context of criminal proceedings, a clear, logically structured and legally sound court decision not only guarantees the rights of the parties, but also contributes to the formation of a unified court practice, prevents arbitrariness and increases public confidence in the judicial system. The article reveals the connection between the accessibility of the legal content of a court decision and the level of trust in the judicial system. The author analyses international standards of judicial clarity and national judicial practice. The author substantiates the thesis that unclear court decisions reduce the effectiveness of law enforcement, make it impossible to properly appeal against decisions and violate the rights of the parties. It is noted that the comprehensibility of a court decision is not only a formal requirement, but also a substantive component of ensuring the efficiency of criminal proceedings, legal certainty and legitimacy of judicial law enforcement in a democratic state governed by the rule of law. Therefore, in our opinion, improvement of the practice of court decision writing is possible through: introduction of a separate provision in the CPC of Ukraine on the requirement of court decision clarity; enhancement of the communication competence of judges (training in legal writing); introduction of a single template of the structure of a court decision with a clear division into parts (factual, legal, motivational, and effective); revision of linguistic and stylistic standards - rejection of excessive clerical language, legal clichés and tautologies; involvement of the public and experts in the analysis of practice and improving the forms of judicial acts. The article proposes conceptual approaches to improving the formation, structure and language of court decisions in criminal procedure of Ukraine. The clarity of a court decision is a key factor affecting the efficiency of criminal proceedings, legal certainty and the level of trust in the judicial system. This aspect is insufficiently regulated in the national legal framework, which creates significant challenges for the parties to the proceedings and the public. Implementation of international standards of clarity, development of legal writing and change of the communication culture of the judiciary are necessary for the implementation of the rule of law and justice in Ukraine.
