The article analyzes the functioning of the intelligence ombudsman institution in the Republic of Lithuania. The author makes a comparative analysis of the current legislation of the Republic of Lithuania on oversight of human rights and freedoms in the course of intelligence activities. It is emphasized that currently, the EU countries, in particular, the Republic of Lithuania, have introduced a special type of state activity - criminal intelligence - aimed at preventing criminal activity; detecting criminal activity, as well as persons who prepare, commit or have committed criminal acts; protecting persons from criminal influence, etc. The traditional mechanisms of supervision over the observance of human rights and freedoms that existed before - departmental control, prosecutorial supervision, judicial control, etc. - although still in use, showed signs of bureaucratic red tape, which led to complicated procedures for obtaining appropriate permits for covert actions, wasted time and made it impossible to implement the principle of offensive counteraction to crime. In order to create modern mechanisms for overseeing the observance of human rights and freedoms in the course of criminal intelligence, the Republic of Lithuania has introduced the institution of a specialized ombudsman. Currently, Ukraine is developing a draft law on criminal intelligence as a system of overt and covert search and detective measures and means based on analytics aimed at timely prevention, detection and neutralization of real and potential threats to the national interests of Ukraine, ensuring gradual adaptation of Ukrainian legislation to EU law, and gradual transformation of operational and investigative activities into criminal intelligence. It is emphasized that studying the experience of the Republic of Lithuania in the functioning of the intelligence ombudsman institution will contribute to the formation of a modern and effective system of ensuring human rights and freedoms in the course of criminal intelligence in Ukraine.
